We at Petra-D Type Foundry believe in transparency. These Terms & Conditions (“Terms”) are here to inform you clearly about how we run our eshop and what you agree to when purchasing our fonts.

These Terms govern the use of the website www.petra-d.com and the purchase of digital font software (“Fonts”) from Petra-D Type Foundry, operated by MgA. Petra Dočekalová, Ph.D., with a registered office at Chodounského 1399/21, 716 00 Ostrava 16, Czech Republic, Company ID: 03238431, VAT ID: CZ9153095908.

By accessing Petra-D website and purchasing it’s digital fonts, you agree to these Terms and to the terms of the End User License Agreement (EULA), which governs all use of the Fonts. For details please read the full EULA

1. Ordering and Payment

Orders are placed exclusively through the online e-shop at www.petra-d.com. The buyer must select the desired fonts, choose the applicable license type and user size, provide accurate billing details, and agree to the EULA, Privacy Policy and these Terms to complete the order.

Accepted payment methods includes Credit/debit cards, Apple Pay, Google Pay and Bank transfer (with manual processing and delayed access to downloads).

When buyer place a first order, a personal customer account is automatically created. From this account, buyer can access and download purchased fonts – anytime.

Petra-D Type Foundry is not obligated to accept an order, particularly if a customer had previously violated the EULA.

2. Delivery

Upon successful payment, buyer will be immediately redirected to customer account to download fonts. Also, an email confirmation is sent to buyer’s email address provided during checkout, with a link for download fonts. In the case of bank transfer, the download link will be issued once the payment has been confirmed. Fonts are delivered as compressed .zip files containing font files in the selected format(s).

The Licensor’s delivery obligation is considered fulfilled once the download link is sent to the provided email address. Please ensure you download from the customer account and verify the functionality of the fonts within 30 days of delivery.

3. Value Added Tax (VAT)

Each party is responsible for declaring VAT according to the conditions of the given country. 

  • VAT is applied to all orders within the EU.
  • If you’re located outside the EU, no VAT will be charged.
  • If your business is in the EU and you have a valid VAT number, enter it in your account details — VAT will then be excluded at checkout.
  • I use the European Commission’s database to validate VAT numbers. 

4. Returns and Cancellation

Due to the nature of digital content, Fonts cannot be returned or exchanged once they have been downloaded. By confirming the order and accepting the EULA at checkout, the customer expressly waives their right to withdraw from the contract under §1837 of the Czech Civil Code (implementation of EU Directive 2011/83/EU on digital content).

In the event of technical failure or defects in the Font Software, a warranty claim may be submitted in accordance with the process described in the EULA. If remediation or replacement is not possible, a refund may be issued.

5. Use of Fonts

All use of Fonts is subject to the EULA. Customers are granted a non-transferable, non-exclusive license to use the Fonts as described in their specific license type (e.g. Desktop, Web, App and other). Unlicensed use, reselling, distribution, or modification of the Fonts is strictly prohibited.

The Fonts may only be used by the licensed party and for the specific scope of use defined during the order process. Extended, exclusive and custom licensing must be arranged separately by email.

6. Limitation of Liability

Font Software is provided “as is”. Petra-D Type Foundry makes no warranties beyond those expressly stated in the EULA. The Licensor is not liable for indirect, incidental, or consequential damages resulting from the use or inability to use the Fonts. Total liability is limited to the amount paid for the license.

7. Intellectual Property

All Fonts, designs, and materials provided on this site remain the exclusive intellectual property of Petra-D Type Foundry. Nothing in these Terms or in the EULA transfers ownership of any intellectual property to the Licensee.

8. Website Use

The Petra-D Type Foundry website and its content (including font previews, images, and texts) are protected by copyright and may not be copied, reproduced, distributed, or otherwise used without prior written consent.

Petra-D Type Foundry is not liable for the content of external websites that may be linked from this domain.

The user is authorised to use this website including its content only for its own private non-commercial use (unless agreed by Terms and EULA otherwise) in accordance with applicable laws, these Terms, fair use and fair business dealings. The user is authorises to use this website in a manner that does not disrupt its operation, security and integrity.

9. Data Protection

No payment data is stored by Petra-D Type Foundry. Payment data is used solely for processing orders via ThePay pay gate. For details how your data is processed, see the Privacy Policy and Cookie Policy.

10. Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by the laws of the Czech Republic. Consumers may also use the EU’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Out-of-court dispute resolution

  1. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, internet address: https://adr.coi.cz/cs, is responsible for the out-of-court resolution of consumer disputes arising from a purchase contract. The online dispute resolution platform located at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the seller and the buyer arising from a purchase contract.
  2. The European Consumer Centre Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.evropskyspotrebitel.cz, is the contact point pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on the resolution of consumer disputes on-line).
  3. The seller is authorised to sell goods on the basis of a trade license. Trade license control is carried out within its scope by the relevant trade license office. The Czech Trade Inspection Authority, to a limited extent, supervises, among other things, compliance with Act No. 634/1992 Coll., on consumer protection.

By purchasing and using the Fonts, you acknowledge that you have read, understood, and agree to be bound by the Terms and the terms of Petra-D’s EULA.

The Petra-D Type Foundry may unilaterally change these Terms. The changes do not affect the rights and obligations that arose under the previous version of the Terms.
